Motions and Appeals in Immigration Proceedings

Official abstract

Proposed regulations were published in the Federal Register on June 7, 1994 concerning motions and appeals in immigration proceedings and on May 13, 1994 concerning fees. The June proposed rulemaking was promulgated to implement section 545 of the Immigration Act of 1990, Public Law 101-649, which requires both time and number limitations on motions to reopen and reconsider and changes in the substantive and procedural aspects of motion and appeal practice. The May proposed rulemaking was promulgated to establish an alternative procedure for filing proof of fee payments with the Board of Immigration Appeals (the ``Board'').
