"K" Nonimmigrant Classification for Spouses of U.S. Citizens and Their Children Under the Legal Immigration Family Equity Act of 2000

Official abstract

This rule amends the Immigration and Naturalization Service (Service) regulations to implement section 1103 of the Legal Immigration Family Equity (LIFE) Act, Public Law 106-553. Section 1103 of the LIFE Act creates a new nonimmigrant classification for the spouses of U.S. citizens and their children. Previously, spouses of U.S. citizens and their children who were the beneficiaries of pending or approved petitions could enter the United States only with immigrant visas. Following the enactment of LIFE, spouses of U.S. citizens and their children who are the beneficiaries of pending or approved visa petitions can be admitted initially as nonimmigrants and adjust to immigrant status later while in the United States. This regulation implements the new K nonimmigrant classification for the spouses of U.S. citizens and their children, and establishes filing and adjudication procedures for it. Following publication of this interim rule, aliens will be able to apply for this new K nonimmigrant status.
